Does the CO2-Prestatieladder apply to your company?

Legally it applies to nobody. Commercially it applies to anyone bidding where a Dutch buyer scores it. A three question test you can run in a minute. The scheme is voluntary and has no size, sector or turnover threshold, so nobody is legally in scope. The test is commercial, not legal.

Legally, the CO2-Prestatieladder applies to nobody. It is a private certification scheme owned by SKAO, not Dutch law, and no inspector enforces it. There is no size test, no turnover test and no sector test written into the scheme. The question worth a minute of your time is a commercial one: does a buyer you want to sell to attach an award advantage to it? If the answer is yes, the Ladder governs your revenue even though it does not govern your company. Three questions settle it.

Question 2 is the one people skip. Use of the Ladder is a choice each contracting authority makes per procurement. SKAO's Handreiking Aanbesteden is advice to buyers, not an obligation on them, so there is no register that tells you whether your next tender will score it. You have to read the documents for the procurements you actually chase.

Why is "does it apply" the wrong question?

Because the scheme answers it with a shrug. Any organisation may seek certification. None has to. SKAO sets no eligibility gate, so a two person engineering firm and a national contractor are equally free to certify and equally free not to.

The force comes from somewhere else entirely. SKAO states the Ladder has been used in more than 5,000 tenders and by more than 300 contracting authorities. That is the number that decides whether it applies to you, and it is a number about buyers rather than about you.

The practical translation: the Ladder behaves less like a regulation and more like a price. If you never bid where it is scored, ignoring it costs nothing. If you bid where it is scored, ignoring it is a discount you hand to the competitor who did not.

Which buyers actually score it?

Two make the point better than a list would, because they run different numbers on the same instrument.

Rijkswaterstaat moved to Handboek 4.0 on 1 July 2026, for procurements published on TenderNed after that date. Its weighting is a fictieve korting, a notional reduction of the bid sum applied for scoring purposes, of 2 percent for trede 1, 4 percent for trede 2 and 6 percent for trede 3.

ProRail has applied the Ladder in its procurement since 1 December 2010 and says the resulting discount can run up to 10 percent across virtually all of its tenders. From 1 January 2027 it intends to use Handboek 4.0 in newly published TenderNed procurements where the Ladder is an award criterion, with a provisional weighting of 4, 7 and 10 percent by trede. ProRail's own wording is voorlopig, meaning provisional, and it warns that a different weighting can apply to some tenders.

So the same certificate is worth roughly twice as much at one buyer as at the other. Anyone who tells you the Ladder is worth a fixed percentage has not read two tenders.

Does your sector decide the answer?

No, but it predicts it well.

Certificate holders cluster in construction, civil engineering, rail, installation, engineering consultancy and the supply chains that feed them. That is not because the scheme excludes anybody. It is because those are the markets the contracting authorities that award on the Ladder buy in. A software firm selling to the same authorities is not barred from certifying; it simply rarely meets a tender that scores it.

If you sit outside that cluster, question 2 will usually answer itself. Check anyway if you supply into a main contractor, because the demand can reach you as a contractual pass through from somebody above you rather than as a criterion in your own tender.

What do you do if you are in?

Not what most people assume. You do not need to hold a certificate to bid. At inschrijving, the bid submission, you state the CO2-Ambitieniveau at which you will execute the project, and you prove it during execution with a certificate or a projectverklaring, a project declaration covering that specific contract. That decouples the sales decision from the audit calendar.

So the first move is choosing a target trede, meaning rung, under Handboek 4.0.

The 2050 horizon in the last row is a trede 3 certification requirement. It is not a deadline the scheme sets for everyone, and it is not a legal one.

What if you are out?

Then say so plainly and move on. There is no filing, no notification and no consequence, because there is nothing to be out of.

Two things are still worth doing. Re-run question 2 each year, since an authority can add the criterion to a procurement it previously ran without one. And keep this question separate from your other reporting questions: if a customer or a bank is asking you for emissions data, that is a different instrument with different rules, and the VSME standard is usually the lighter answer for an unlisted company. VSME consulting is the route there.

What does being in actually cost you in data?

An audited organisational greenhouse gas inventory, refreshed annually, that a certifying body can trace back to source. Scope 1 and 2 from trede 1, quantified scope 3 from trede 2. Under Handboek 4.0 the base year at an initial audit may not sit more than three years before the year of that audit, so a footprint you built once and left alone will not survive first contact.

That is a system question rather than a spreadsheet one. The Hedgehog platform names the CO2-Prestatieladder as a reporting output, carries over 20,000 spend-based and activity-based factors you can supplement with supplier-specific data, and reports 5,000+ users on its platform page. The honest limitation, stated before an auditor finds it: a small business reviewer on G2 in August 2026 rated it 5 out of 5 and still said loading data is manual and takes real effort, though it works well once loaded. Budget for the loading.
